Abstract : All praise is due to Allah, and may Allah's peace and blessings be upon His messenger, Mohammed, who was sent as a mercy to all the mankind. Recently, many violations of children rights have occurred in societies, and more specifically within families, which necessitates that efforts come together in order to protect children. Therefore, the subject of this thesis has been chosen to present the Islamic law’s (sharia’s) stance of domestic violence against children (child abuse) and the subsequent juristic judgments of child abuse. This study includes an introduction, a preamble, five chapters, and a conclusion. The preamble presents the importance of family in Islam and the contemporary challenges that face the family. It also shows the mercifulness of Islam towards children. The first chapter “Domestic violence against children (child abuse) and its causes” consists of two sections: first, domestic violence against children (child abuse) and its forms; second, the causes of domestic violence against children (child abuse). The second chapter “Islamic regulations against child abuse” is in two sections, too. Firstly, it discusses the Islamic regulations against the physical child abuse before birth, and secondly it discusses the Islamic regulations against physical child abuse after birth. The third chapter of the study “The Islamic regulations of non-physical child abuse” has two sections: first, the Islamic regulations against financial child abuse, and second the Islamic regulations against psychological (emotional) child abuse. The forth chapter “The legislative measures to prevent domestic violence against children” discusses both the individual, social and economical precautionary measures, and the regulatory and disciplinary measures. The fifth chapter “Some contemporary judicial applications on domestic violence against children in the Saudi Arabian legal system” presents judicial application on the case of sexual abuse, physical abuse, and custody rights. The study is conducted using the descriptive-analytical research methodology. The jurisprudential issues that are subject to dispute have been examined through both comparing the opinions of the famous Four Juristic Schools and presenting the opinions of the scholars chronologically. As for the thesis’s final arrangement, it has been designed in accordance with King Abdulaziz University Research Handbook. Some of the most significant findings of the study are its emphasis on Islam’s care of children rights and their safety; its presentation of the Islamic legislations on domestic violence against children; and its clarification of the consistency of the subsequent juristic judgments of child abuse with and the Islam’s care for the family ties continuity. In conclusion, the study calls for raising public awareness of children rights and taking the necessary provisions and apply them.
