Abstract : The purpose of the thesis is gathering and studying the juristic cases similar in form and different in provision that Imam Kassani referred to differentiate among them. The importance of the subject lies in knowing the juristic differences in order to remove illusions aroused by those claiming jurisprudence has contradiction due to giving the different provisions for the same issue. Hence، the reason of selecting subject is clearly shown. The book "Badaye Alsanaye" book for Imam Kassani cared about showing the jurisprudence differences between issues as well as care about explaining the difference between juristic doctrines in many topics. The Imam position in Hanafi doctrine is known and his book is one of the approved books in the Hanafi doctrine. My work in this research is extracting the differences from the book and gathering them using the styles referring to differentiation between two cases and studying them. The research included an introduction، preamble، two chapters and conclusion. The introduction stated the detailed definition of Imam Kassani، his methodology in the book، the science of juristic differences in terms of its emergence، importance، and literature. Chapter one dealt with juristic differences in fasting such as provisions، pillars، types، and favors. The two chapters have twenty seven sections each one has a suitable title. Each section includes a juristic difference showing the case and text of Imam Kassani about the difference، definitions of idioms in the disputed cases، stated the opinions of scholars in the four doctrines، and stated the proofs and weighted one of them. The conclusion records the most significant findings revealed by the reach including: what related to Badaye Alsanaye book and its author Imam Kassani who have a highly academic rank among scholars، the position of the book which was praised by a set of scholars. Other findings are related to the juristic differences in fasting and eitikaf. The research refers that the justice differences are not the same in terms of strength and weakness and trueness or clearness in other chapters of Badaye Alsanaye and other juristic books.
