In the name of Allah, Most Compassionate, Most Merciful, and peace be upon His Prophet, his family and companions.
This research deals with the jurisprudential rulings related to the night in the Book of Zakat, Fasting, and Pilgrimage, a comparative jurisprudential study. The research includes an Introduction, Preface, 3 chapters, Conclusion and Indexes. In the Preface, there is a definition of the night and what relates to it. Chapter One, presents the Jurisprudential rulings related to the night. In the Book of Zakat (alms-giving), there are rulings on payment of Al-Fitr Zakat (after Ramadan) on the eve of Eid Al-Fitr ( the Feast of Breaking the Fast of Ramadan), giving in advance this Zakat one or two nights before Eid, the commencement of Zakat annual payment upon the onset of the night, and a ruling on cutting palm-trees at night.
Chapter Two deals with the night-related jurisprudential rulings in the Book of Fasting, such as those concerning the night preceding the month of Ramadan, the meaning of the white thread and the black thread, predominating the intention to fast from the night as regards obligatory and non obligatory fasting, in addition to the ruling of predominating the intention to fast from the night for a non-accountable Muslim who reaches puberty during the day, in addition to rulings concerning the fasting of the one who sleeps or loses conscious the whole night and misses predominating the intention to fast from the night. Also, the Chapter includes rulings on predominating the intention to fast on the doubtful night (of Ramadan), the continuation of fasting day and night, and the ruling on the one who eats while in doubt of the onset of dawn or the sunset; besides, it deals with the rulings of ʻEitekaafʼ (seclusion for worship in the mosque) at night only, the beginning of Eitekaaf for the its performer, fasting from talking till the night, and the ruling of the one who has sexual intercourse with his wife at night till the onset of dawn, in addition to the ruling on determining the night of Al-Qadr (the Night of Decree). Chapter Three comprises the jurisprudential rulings concerning the night in the Book of Pilgrimage, in which a definition of pilgrimage (Hajj) and Umrah (lesser pilgrimage) is introduced in addition to the ruling of performing Umrah the night preceding the first of Ramadan, and performing Umrah after the sunset of the last day of Ramadan. There are additional rulings concerning saying (Talbiyah) when night is approaching, entering Makkah at night to perform Hajj, staying at Arafat till the night, staying at Arafat at night only and the duration of this stay at night, staying the night at Muzdalifah and the obligatory time for staying at Muzdalifhah, the ruling for the one who misses staying the night at Muzdalifah, performing Aqabah stoning pillar the night of Sacrifice Day, performing tawaf al-ifadah (circumambulation) on the night before the Sacrifice Day, staying the night at Mina and its time period, and not staying the night at Mina; rulings for those who intend to hasten their departure from Mina before the sunset of day (12), then they return to Mina on the night of day (13) and slaughter the sacrifice at night.
One of the study's objectives is to gather the scattered information. Thus, I have the view to gather the jurisprudential issues related to the night in the Book of Zakat, fasting, and pilgrimage that are scattered in various books and put them in one place in order to easily reach religious rulings. Undoubtedly, this is one of the crucial issues to which care should be given. Besides, this topic involves new issues for which there is a dire need to know their rulings, particularly as time has changed.
In the end, there is a recommendation to gather all the issues related to daytime and put them in one place in order to find their religious rulings easily. |
