Abstract : This research investigates the regulations and laws that related to the termination of government employees due to incompetence in different countries, specifically, in Egypt, France, and finally Saudi Arabia and, hence adopting a comparative methodology. This done by reviewing and analyzing termination laws in these countries and the research found that the legal system of terminating such employees is not clear and has not been studied carefully in most of the civil services laws as well as executive regulations. In terms of structure, the research is divided into 4 chapters to clarify the legal texts capacity that govern these issues and taking into consideration the judicial applications. As a conclusion, this research provides several recommendations to develop these laws and the most important one is that professional competence is a central factor that most be maintained before the beginning of employee’s work and even after he begins in order to sustain his job and not to be subject to incompetence. In other words, if the employee lost this professional competence this means he is more likely to be vulnerable to termination. The research strongly advice the concept to mention the professional efficiency in the government’s legal texts and laws and to indicate cases in which one may get terminated due to professional incompetence.
