Abstract : This research is a critical jurisprudential study that deals with the Orientalists' perspective regarding the juristic understanding of fasting, seclusion in a mosque (for worshipping Allah) and pilgrimage in Islamic legislation through the Islamic Encyclopedia. It contained an introduction, a preface, two chapters, conclusion and indexes. The Preface introduces the terms of the title and the general characteristics of the orientalists' methods in their study of jurisprudential issues related to understanding fasting, seclusion in a mosque, and pilgrimage according to the Islamic Encyclopedia. Chapter One: The orientalists' stand as regards fasting and seclusion in a mosque. It included three sections. Section one: The Orientalists' stand regarding the definition of fasting, its status in Islam, the method of ascertaining the beginning of the month and conditions of fasting, which were stated in three topics. Section Two: the orientalists' position concerning the pillars of fasting and excuses that permit not fasting, making up for not fasting those days and the expiation for that, which were stated in three topics. Section Three: The orientalists' stand with respect to seclusion in a mosque (for worshipping Allah). It included two topics. The First: The orientalists' perspective of seclusion in a mosque, its ruling, and time. The Second: Their perspective as regards some rulings related to seclusion in a mosque. Chapter Two: The orientalists' stand regarding pilgrimage. It included three sections. Section One: Their position as regards pilgrimage, the definition of pilgrimage, the origin of its legality, its ruling, types of rites and pillars of pilgrimage, which were stated in two topics. Section Two: The orientalists' stand as regards the pilgrimage duties. It included three topics. The First: The orientalists' stand regarding the ritual consecration (Ihram) from Miqat and staying the night in Muzdalifah. The Second: Their view as regards throwing the pebbles, shaving the head or cutting the hair. The Third: Their viewpoint regarding Hadie (offering) al-Tamatu’ and Qiran, and farewell Tawaf. Section Tree: Their viewpoint with respect to the recommended acts of pilgrimage, and forbidden acts during Ihram, which came in two topics. The significance of this research stems from the fact that it is related to the study of the Islamic Encyclopedia that is considered one of the biggest and most critical orientalist studies and the most prevalent one, in addition to its relevance to the investigation of the information contained in the Encyclopedia with respect to two pillars of Islam: fasting and pilgrimage. The research objective: is to conduct a critical study of what is mentioned in the Islamic Encyclopedia of jurisprudential issues in the chapters of fasting and pilgrimage in order to distinguish right from wrong, state the shortcomings mentioned in them, and to attempt presenting the most important features of the orientalists' method in writing about the Islamic jurisprudence (with respect to understanding fasting, seclusion in a mosque and pilgrimage). As for the research method, it is the critical-induction method, which necessitated deducing and tracing matters related to the understanding of fasting, seclusion in a mosque and pilgrimage that are mentioned in the summary of the Islamic Encyclopedia. It also necessitated ordering the research chapters and topics according to the subject-jurisprudential order, sticking to mentioning the text or texts, as stated in the summary of the Islamic Encyclopedia at the beginning of each subject. Then, it stated the axes included in the text in one topic, to be followed by initiating a comparative, jurisprudential study of issues stated so that it would be carried out on a neutral basis as well as identifying aspects of right, wrong and shortcomings in order to discuss them. The most significant results of the research: The orientalists' writings about related matters to the understanding of fasting, seclusion in a mosque and pilgrimage are varied in terms of their proximity and remoteness from the correct scientific method as far as objectivity, accuracy, fairness and honesty in transmission are concerned, because they committed methodological and scientific errors. Despite the orientalists' discrepancy in their methods, yet most of them share in their attempts to throw doubts on the authenticity of the legality of these two pillars: fasting and pilgrimage, and deny the divinity of their source either by implying or by stating it explicitly. Therefore, the Islamic Encyclopedia cannot be considered a reliable reference for knowing the Islamic jurisprudential rulings pertaining to the understanding of fasting, seclusion in a mosque and pilgrimage. The most significant recommendations in this research are: To warn against being deceived by The Islamic Encyclopedia for the wrong or inaccurate information it contains - To urge honest researchers to address what is written in this Encyclopedia in Critical Studies, and publish that in e-sites and public libraries - To spur researchers in the Muslim World to exert concerted efforts for preparing an Islamic scientific encyclopedia that is supervised by Muslim specialists.
