All praise be to Allah, and His peace and blessings be upon His Messenger.
This research is a deduction, compilation and study endeavour of the jurisprudential rules and controls from the Book ‟Matalib Uli al-Nuha, Sharh Ghayaat al-Muntaha” in the two Books of "Will" and "Obligatory Rules of Inheritance". The study includes an Introduction that contains the research problem, objective, significance previous literature, adopted general method and adopted special method. Then follows a Preface. It includes two themes. The First: An Introduction to the author. The Second: Introducing the Book of ‟Matalib Uli al-Nuha, Sharh Ghayaat al-Muntaha”. Then comes Chapter One, which includes five topics. The First: The origin of the Science of Jurisprudential Controls. The Second: A definition of jurisprudential rules. The Third: A definition of Jurisprudential controls and the difference between them and jurisprudential rules. The Fourth: A definition of fundamentalist rules and the difference between them and jurisprudential rules. The Fifth: A definition of jurisprudential theories and the difference between them and the jurisprudential rules. In Chapter Two come major jurisprudential rules, with all included rules, and the agreed-upon, non-major rules. This chapter consists of six topics. Chapter Three deals with the jurisprudential rules of "Wills". It includes two topics. The First: The jurisprudential, agreed-upon controls in the Book of "Wills", which consists of eight themes. Topic Two: the jurisprudential disagreed-upon controls in the Book of "Wills", which includes two themes. Then comes Chapter Four, which addresses the jurisprudential controls of obligatory rules of inheritance. It consists of two topics. The First: Jurisprudential, agreed-upon controls in the Book of "Obligatory rules of inheritance", which includes ten themes. Topic Two: Jurisprudential, disagreed-upon controls in the Book of ""obligatory rules of inheritance". It consists of four themes. Finally comes the Conclusion, which includes significant results and recommendations. Among the results are: the number of jurisprudential rules and controls deduced is forty one, and some branches might be an application of a group of rules. As for the recommendations, they propose holding applied practical training courses on how to deduce jurisprudential rules and controls and complete the service of the Book ‟Matalib Uli al-Nuha, Sharh Ghayaat al-Muntaha” by working on deducing the fundamentalist rules from it.
